Owners of land adjacent to roads are required to maintain the slopes (embankments or side banks) in a condition that ensures road safety. They must prevent landslides, ground collapses, and any situation that could compromise the stability of the road or its appurtenances.
This means they must take care of both the uphill side (above the road) and the downhill side (below the road), preventing soil erosion, falling rocks, or the accumulation of material that could obstruct the roadway. They must also maintain any supporting structures, such as retaining walls, to ensure ground stability.
If necessary, owners must carry out maintenance work or build appropriate structures to keep the terrain stable. They must also avoid any activities that could cause landslides or collapses, such as uncontrolled excavation or alterations of the land.
Anyone who fails to comply with these obligations is subject to an administrative fine. In addition to the fine, they are required to restore the area at their own expense, ensuring safe conditions are re-established.
For the theory exam, it is important to remember that the stability of land adjacent to the road is the responsibility of the landowners, who must prevent any risk of material falling onto the road.
