Administrative monetary penalties in road law consist of paying a sum of money set between a minimum and a maximum defined by each specific rule. There are also general limits that apply to these amounts, except in particular situations, such as proportional penalties, multiple violations, or periodic updates of the amounts.
When determining the exact amount of a fine, authorities do not automatically apply a fixed value. Instead, they consider the seriousness of the violation. They also evaluate the driverโs behavior after the offence, for example whether the person tried to reduce the consequences, as well as the individualโs personality and financial situation. This means that two people committing the same offence may receive different fines within the legal limits.
Certain important violations, such as those related to speed, right of way, traffic lights, safety distance, manoeuvres, driving times or motorway rules, lead to higher fines if committed at night, between 10 p.m. and 7 a.m. In these cases, the penalty is increased by one third.
The amounts of fines are not fixed permanently. They are normally updated every two years according to inflation, based on the consumer price index calculated by ISTAT. The update is established by authorities by December 1 and applies from January 1 of the following year. Updated amounts are rounded to the nearest euro.
However, in exceptional economic situations, these updates may be temporarily suspended. In such cases, the fine amounts remain unchanged for several years and are updated later when the suspension ends.
