In addition to the appeal to the Prefect, the law provides another option to challenge an administrative fine: an appeal before the ordinary judicial authority. This is an alternative choice, meaning the offender must decide whether to appeal to the Prefect or to the court, but cannot use both procedures at the same time.
The court appeal is only possible if the reduced payment has not been made in cases where it is allowed. Once the fine has been paid in reduced form, the right to challenge it is automatically waived.
The procedure before the court is governed by specific legal rules that define how the opposition must be filed, as well as the timing and method of the decision. In this context, the judge independently evaluates the case, considering both the evidence provided by the authority and the arguments presented by the appellant.
This type of appeal offers broader protection, as it allows for a full judicial review of the case, but it may involve a more formal procedure and, in some cases, longer processing times compared to the administrative appeal to the Prefect.
