When a person receives an administrative fine for a road traffic violation and does not wish to pay it in the reduced amount, they have the right to appeal to the Prefect. The appeal must be submitted within sixty days from the immediate notification or from the formal delivery of the report.
The appeal can be submitted to the office or authority to which the enforcing officer belongs, or sent directly to the Prefect by registered mail or electronically, for example via certified email. The appellant may attach supporting documents and may also request a personal hearing.
If the appeal is sent directly to the Prefect, the Prefect forwards it to the competent office for processing. The office of the enforcing authority has sixty days to send all documents to the Prefect, including technical observations supporting or opposing the appeal.
If no appeal is submitted within the required time and no reduced payment is made, the report automatically becomes an enforceable title. This means that the amount due increases and is calculated as half of the maximum penalty provided by law, plus procedural costs, and enforcement procedures may begin.
In the case of vehicles registered abroad, if it is not possible to recover the amount from the owner or driver through normal procedures, the law allows enforcement against any person later found driving the same vehicle, within a period of five years. Specific rules apply in such cases.
