When an administrative monetary penalty is particularly high, exceeding 200 euros, and the person responsible for payment is in financial difficulty, it is possible to request payment in monthly instalments. This option also applies when multiple violations are recorded in the same report.
To be eligible for instalment payment, the person must have an income below a certain threshold defined by law. This income is calculated based on the most recent tax declaration. If the person lives with family members, the total household income is considered, and the threshold increases for each additional family member.
The request must be submitted to the competent authority, which depends on who issued the violation. It may be the Prefect or, in some cases, regional, provincial, or municipal authorities.
The authority evaluates the request based on the applicantβs financial situation and the total amount to be paid. The number of instalments depends on the amount: up to twelve instalments for lower amounts, up to twenty-four for medium amounts, and up to sixty for higher amounts. Each instalment must not be less than 100 euros. Interest is applied to the instalment plan.
The request must be submitted within thirty days from the notification or immediate contestation of the violation. By submitting the request, the offender waives the right to appeal the fine. The authority has ninety days to accept or reject the request; if no decision is made within this time, the request is considered rejected.
If the request is accepted, the person receives a payment plan. If it is rejected, the full amount must be paid within thirty days from the notification of the rejection.
Once instalments are granted, the authority monitors the payments. If the first instalment is not paid, or if two instalments are missed, the benefit of instalment payment is automatically lost and standard enforcement procedures apply.
The amounts and thresholds set by law may be updated every two years based on inflation, according to ISTAT indexes.
