When a violation of road law is committed, the general rule is that it must be immediately notified to the driver, whenever possible. This means that the enforcing officer should stop the offender and inform them of the violation on the spot. The notification must be given not only to the driver but also to any person jointly liable for the payment, if present.
After the notification, an official report is prepared. This report must also include any statements that the offender or other involved persons request to be recorded. The report may be created using digital or electronic systems.
The document must contain a clear and brief description of the violation, along with essential information to identify the offender and the vehicle, such as the license plate number. These elements are necessary to ensure the validity of the procedure.
A copy of the report must be immediately given to the offender and, if present, to the person jointly responsible. This allows them to know the details of the violation right away.
Finally, another copy of the report is sent to the office or authority to which the officer belongs, for administrative processing of the case.
