Atypical vehicles: definition and rules

Atypical vehicles are vehicles that, due to their structure or function, do not fit into any of the standard categories defined by the highway code, such as motor vehicles or motorcycles. These are usually special or innovative vehicles that cannot be immediately classified within existing categories.

To allow their circulation, an official classification must be established. The Minister of Transport, together with other relevant authorities, determines which existing category the atypical vehicle should be assigned to. This classification is essential because it allows the application of the corresponding rules for circulation and driving.

In addition to classification, the technical requirements that the vehicle must meet in order to circulate on the road must also be defined. These requirements are determined by comparing them to those of similar vehicles, ensuring safety and compliance with regulations.

If an atypical vehicle is used on the road without having its technical and functional characteristics officially defined, it is not allowed to circulate. In such cases, the driver is subject to an administrative fine. Furthermore, the vehicle may be confiscated and even destroyed, as it is not considered suitable for road use.

For the theory exam, it is important to remember that atypical vehicles can only be used on the road after official classification and approval. Without this, their circulation is prohibited and subject to severe penalties.
