When a violation of traffic law constitutes a crime rather than just an administrative offense, the police officer must immediately inform the public prosecutor. This is done without delay, according to criminal procedure rules.
If the violation results in a crime against a person, such as injuries in a road accident, the obligation to notify the public prosecutor is even more urgent.
Once the criminal proceedings are concluded with a final decision, the court communicates the outcome to the Prefecture. If there is a conviction, it is recorded on the driverβs license, affecting the driverβs administrative status.
In some cases, the judicial authority may determine that the act does not constitute a crime but only an administrative violation. In such situations, the case is returned to the police or competent office to proceed with administrative penalties. The deadlines for these procedures start from the moment the office receives the case again.
This rule ensures proper coordination between criminal and administrative procedures, guaranteeing that each violation is handled appropriately.
