When a traffic violation, although not a crime itself, is connected to a more serious criminal offense, the law provides that the criminal judge handles both matters.
If determining a crime requires assessing an administrative violation and the reduced payment has not been made, the criminal judge responsible for the offense also decides on the administrative violation. In case of conviction, the judge applies the corresponding administrative penalty as well.
However, this competence is not always permanent. If the criminal proceedings end without a conviction, for example due to extinction of the crime or lack of procedural conditions, the criminal judge no longer has authority over the administrative violation.
In such cases, the matter returns to the administrative authority, which proceeds according to the standard rules.
This rule avoids duplication of proceedings and ensures that connected facts are handled together by the same judge.
