Obligations of service concessionaires

Public service concessionaires that use or cross roads—such as railways, tramways, electric and telephone lines, water pipelines, gas pipelines, sewer systems, and other installations—are required to comply with all conditions and requirements imposed by the road authority. These rules are intended to ensure both the preservation of the road and the safety of traffic.

When transport-related services are involved, such as railways or tramways, the measures taken must also be communicated to the Ministry of Transport or the relevant regional authority. This ensures coordination between the different authorities involved.

If, due to traffic or road needs, it becomes necessary to modify or relocate existing installations (such as pipelines or lines), the cost of relocation must be borne by the public service operator. In other words, the operator is responsible for adapting their infrastructure to new road requirements.

The timing and methods for carrying out these works must be agreed in advance between the road authority and the service operator, balancing the different public interests involved, such as service continuity and road safety.

If the service operator delays the required works without justification, they must compensate for any damages caused and pay any penalties предусмотренные in the relevant agreements.
