Infographic: Road permits and authority responsibilities

Authorizations and concessions related to road use are generally issued by the road authority that owns the road. This may be the state, a region, a province, or a municipality. In some cases, the road authority may delegate this responsibility to another body or, if the road is under concession, to the concessionaire, provided this is done according to existing agreements. Any delegation must be communicated to the relevant authorities, such as the Ministry of Infrastructure and Transport or the prefect.

The main rule is therefore that every authorization or concession depends on the authority that owns or manages the road. This applies to all activities affecting the road area, such as works, installations, accesses, or crossings.

However, there is an important exception within built-up areas. For sections of state, regional, or provincial roads located within municipalities with fewer than 10,000 inhabitants, authorizations and concessions are issued by the municipality. Even in this case, however, prior technical approval (clearance) from the road owner is required. This means that the municipality manages the procedure, but the final decision must still be technically approved by the road authority.

For works related to the installation of ultra-fast electronic communication networks, the required clearance must be issued within fifteen days from the municipality’s request. This rule is intended to speed up the development of digital infrastructure.

In the case of particularly complex and important works, such as railway or tramway lines, pipelines, or other public service infrastructures that affect or cross the road, authorization is no longer handled solely by the road authority. In these cases, a decree from the Minister of Infrastructure and Transport is required. This authorization is granted only in cases of absolute necessity and when no technical alternatives exist, after consulting the relevant authorities, including the road owner and, if necessary, the Ministry of Transport.

In summary, for the theory exam it is essential to remember that road authorizations always depend on the road authority, with some exceptions in built-up areas and in special cases involving major infrastructure, where higher-level authorities are involved.
