When criminal proceedings end with a final conviction, the prefect is responsible for applying the administrative penalties affecting the driving license. If the law provides for suspension, the prefect issues the measure according to the duration set by the judge and informs the transport authority.
If revocation is required, the prefect must act quickly: within fifteen days from receiving the final judgment, they issue the revocation order and notify the driver.
If the crime is extinguished due to the death of the accused, the administrative penalty is also extinguished. If the crime ends for other reasons, the prefect still evaluates whether the conditions for suspension or revocation exist and proceeds accordingly under general rules.
It is important to note that if the penalty is extinguished after a final conviction, the administrative sanction on the license still remains valid.
If the case ends with a final acquittal, the prefect orders the return of the driving license. This decision is communicated to the driver and officially recorded.
This procedure ensures that criminal court decisions are effectively translated into concrete measures on the driving license, maintaining road safety.
