Certain activities or facilities can pose a risk to road safety or public health, especially if they are located too close to the road. For this reason, the law requires specific installations such as shooting ranges, storage facilities for explosives, gas or flammable liquids, quarries using explosives, and other potentially hazardous facilities to maintain minimum distances from roads.
These distances are usually defined by specific laws regulating each type of activity. However, if no specific rules exist, the local prefect determines the required safety distance. This decision is based on technical evaluations and includes input from road authorities and fire services to ensure that traffic and public safety are not at risk.
The purpose is to prevent situations where accidents, explosions, fires, or other emergencies could directly affect the road or endanger its users. For example, placing a fuel storage facility too close to a road could significantly increase the danger in case of an accident.
Anyone who does not comply with these requirements is subject to a high administrative fine. In addition, they must restore the situation at their own expense by removing or adjusting any non-compliant structures.
