In some cases, in addition to a fine, the Highway Code provides for an additional penalty requiring the suspension or termination of a specific activity. This may concern activities related to vehicle operation or services carried out on the road.
When the violation is identified, the officer indicates this obligation in the report. The report serves as the legal basis for both the fine and the additional penalty. If necessary, the suspension must be carried out immediately; otherwise, it must begin within five days from the report or its notification.
The enforcement of the suspension is supervised by the authority to which the officer belongs. If the offender appeals the fine, the appeal automatically includes the additional penalty. If the prefect rejects the appeal, the suspension is confirmed; if the appeal is accepted, the additional penalty is also cancelled.
If the offender does not comply with the obligation within the required time, they commit a criminal offence and may be reported. In such cases, the authority may enforce the suspension directly. The costs of this enforcement are charged to the offender through an enforceable order issued by the prefect.
If the activity is subject to certain conditions and the offender later complies with them, they may request to resume the activity. The authority verifies that the requirements are met and, if so, allows the activity to continue, informing the prefect.
